# Innocent spouse relief

IRS Ohio City of Canton

Checked against official sources October 10, 2026.

## Short answer

A joint return makes both spouses liable for the full tax. Under 26 U.S.C. § 6015 the IRS can grant innocent spouse relief, separation of liability, or equitable relief. Innocent spouse relief must be requested on Form 8857 within two years of an IRS notice of audit or taxes due.

## The three kinds of relief

*Relief under 26 U.S.C. § 6015*

| Type | For whom | Result |
| --- | --- | --- |
| Innocent spouse (§ 6015(b)) | Tax understated on a joint return because of the other spouse's errors, without knowledge | Relief from the understated tax, interest and penalties |
| Separation of liability (§ 6015(c)) | Divorced, separated or no longer living with the spouse | Pay only one's own share of the understated tax |
| Equitable relief (§ 6015(f)) | Not eligible for the other two, but it would be unfair to hold the person responsible | Relief from understated or unpaid tax |

Errors that understate tax include unreported income, incorrect deductions or credits, and incorrect asset values.

## Preparing the request

- **Pull the transcript for each joint year.** Find which years and items created the balance.
- **Write down what was known at signing.** Who handled the money, what was discussed, what was hidden.
- **Gather separation records.** Divorce decree, separation agreement, proof of living apart — relevant to separation-of-liability relief.
- **File Form 8857.** One form covers innocent spouse, separation of liability and equitable relief. The IRS decides which applies.
- **Expect the other spouse to be contacted.** The IRS contacts the spouse or former spouse to ask whether they want to participate, and review can take six months or longer. Tell the professional if safety is a concern.

If the joint balance came from a spouse's unreported side income, the CP2000 that flagged it is explained in [the CP2000 guide](https://www.cantontaxresolution.top/irs-letters/cp2000/). Other options are compared on [the Canton home page for tax help](https://www.cantontaxresolution.top/).

## Questions people in Canton ask

### My ex caused the tax problem on our joint return. Am I stuck with it?

Not necessarily. Signing a joint return makes both spouses responsible for the whole tax, but 26 U.S.C. § 6015 offers three kinds of relief: innocent spouse relief, separation of liability, and equitable relief. One Form 8857 asks for all three.

### Is there a deadline?

For innocent spouse relief, the request must come within two years of receiving an IRS notice of an audit or of taxes due because of an error on the return. File Form 8857 as soon as the problem is known.

### What if I knew about the error?

Relief is generally not available for errors a person actually knew about, or that a reasonable person in the same position would have known about. There is an exception for victims of domestic abuse who signed or did not challenge the return out of fear.

### Does Ohio have its own version?

Ohio's Attorney General notes that its offer-in-compromise program can accept an offer from a non-earning spouse on a joint liability. A licensed professional can tell whether the state balance should be addressed separately from the federal request.
