# Unfiled returns: catching up

IRS Ohio City of Canton

Checked against official sources October 10, 2026.

## Short answer

IRS Policy Statement 5-133 says enforcement of delinquent returns normally reaches back no more than six years. Unfiled years can be replaced by an IRS substitute return under 26 U.S.C. § 6020(b) without most deductions. Canton separately requires a city return from every resident aged 18 to 65.

## Why quiet years still count

Some people stop filing after a hard year and never get a letter. Others get a CP59 ("no return on file") and set it aside. Either way, the IRS receives W-2 and 1099 data from employers and payers, and it can build a substitute return from that data — without the deductions and credits a real return might claim — then send a CP3219N proposing tax.

*Unfiled years at each layer*

| Layer | Who must file | What happens if not |
| --- | --- | --- |
| IRS | Depends on income, filing status and age (26 U.S.C. § 6012) | CP59; possible substitute return and CP3219N; failure-to-file penalty (§ 6651); refunds held |
| State of Ohio | Ohio residents with Ohio income tax obligations | Assessment, then certification to the Attorney General if unpaid |
| City of Canton | Every resident aged 18–65, even with no tax due; part-year residents of 30+ days | Delinquency letters; $25 late-filing penalty; 15% of unpaid tax plus interest |

## Catching up, in order

- **Pull IRS transcripts.** Account transcripts show which years the IRS shows as unfiled or substitute-filed; wage-and-income transcripts show the W-2 and 1099 data.
- **List all three layers.** Federal Form 1040, Ohio IT 1040, and the City of Canton return for every year — the city requires one from residents aged 18–65 even with no tax due.
- **File the most recent years first if refunds are possible.** Refund claims expire three years after the due date.
- **Use free help where it fits.** Canton's Income Tax Department prepares city returns free; United Way VITA (households up to $69,000) and AARP Foundation Tax-Aide offer free preparation in season.
- **Set up estimates or withholding going forward.** Use the IRS Withholding Estimator and, for Canton, a Declaration of Estimated Tax if $200+ won't be withheld.
- **Then address balances.** Once returns are in, payment plans, hardship status, penalty relief or an offer can be considered.

Unfiled years are especially common when income came in on 1099s with nothing withheld; [getting current as a self-employed filer](https://www.cantontaxresolution.top/self-employed-tax-debt/) covers that pattern. Once the returns are in, [payment plans](https://www.cantontaxresolution.top/ways-out/payment-plans/) or [hardship status](https://www.cantontaxresolution.top/ways-out/hardship-status/) are the usual next questions, and [the Canton home page](https://www.cantontaxresolution.top/) shows how the pieces connect.

## Questions people in Canton ask

### How many years back do I have to file?

IRS Policy Statement 5-133 says enforcement of delinquent returns normally covers not more than six years, with exceptions approved by management. A licensed professional decides the exact set after pulling wage-and-income transcripts. The City of Canton's filing duty is separate and covers every year of residency between ages 18 and 65.

### The IRS already filed a return for me. Do I still need to file?

Usually yes. A substitute return under 26 U.S.C. § 6020(b) may not include deductions and exemptions. The IRS says it remains in the taxpayer's interest to file an actual return. A CP3219N gives 90 days to file or petition the Tax Court, with no extension.

### I think the IRS owes me money for one of those years. Is it too late?

Refunds must be claimed within three years of the return's due date, including credits such as the Earned Income Tax Credit. After that the refund is lost. The IRS also holds current refunds while earlier returns are past due.

### Where do I get old W-2s and 1099s?

An IRS wage-and-income transcript lists what employers and payers reported, available through an IRS Online Account or by mail. For City of Canton returns, the local-tax boxes on old W-2s show what each city withheld.

### Will filing old returns trigger a big bill I can't pay?

It may show a balance, but filing does not mean paying in full that day. Filed returns are what make payment plans, hardship status and offers possible. Penalties for not filing grow each month (26 U.S.C. § 6651), so filing even without payment stops the larger failure-to-file penalty from growing.
